A temporary injunction was obtained by Attorney General Bill McCollum against Lincoln Lending Services, LLC and its owner Rota Gomez thanks to a new state law that prohibits companies from charging upfront fees from people availing of loan modification and foreclosure rescue services. The injunction prohibited Lincoln from taking payments from consumers for mortgage modification and foreclosure rescue services. Lincoln is also prevented from providing consumer-debt related or mortgage modification services.

The impending foreclosure of the vacation home of New Orleans mayor Ray Nagin is proof that the rich and the famous are not recession-proof. The foreclosure however stems from a matter other than non-payment of mortgage. Nagin seems to have been remiss in the payment of his association dues forcing his homeowners association to file a notice of lien with the country court resulting to the scheduled foreclosure sale of his vacation home on April 7.

Just when everyone thought that the housing industry was going down, down, down—here comes a report confirming that the number of home foreclosures actually went down by 10% in November last year. Last November’s data show 201,950 home foreclosure filings which included auction sale notices, default notices and band repossessions. This may be the first double-digit reduction in monthly foreclosure rate but it’s not reason enough to celebrate considering that the foreclosure numbers have increased by 68% compared to the same period in 2006.
